July 5, 2001

U.S. District Judge Wiley Daniel, a federal judge, ruled unconstitutional a state court rule prohibiting some grand jury witnesses from speaking publicly. The ruling could affect witnesses who testified before the JonBenet Ramsey grand jury. Judge Daniel said the rule violated the First Amendment rights of grand jurors. This allows Linda Hoffman Pugh to talk about the testimony she gave before the GJ and paves the way for her to include this information in a book. Judge Daniel listened for about 45 minutes.

Linda stated she felt Patsy had multiple personalities. She claims to have seen this in PR one day. Her theory is that Patsy hit JonBenet by accident.

KUSA in Denver reported that Linda talked about the swiss army knife and how she knew that she put it away in the cupboard and that only one other person knew where that knife was, and that person was Patsy Ramsey.

Bill Nagel said the state would file an appeal.

A brief interview between Darnay Hoffman and Linda was conducted. The transcript for that can be found here:

Governor Owens responded to the latest with respect to Smit and his intruder theory he is peddling by stating that prosecutors can address everything that he has raised that points to an outsider. Ownens feels that if prosecutors respond publicly that they tell the person who killed JonBenet what the prosecutor knows. Owens also believes that what Smit has done is publicize evidence that should have remained private until the trial.

Owens stated that when the grand jury adjourned he gathered prosecutors from throughout the state to analyze the evidence and that after researching the evidence, much of which has not been publicized, he became convinced there is a logical reason why no one has been charged in the case. But Owens wouldn't say what that evidence is.

Smit responded by saying he doesn't believe Owens or Beckner. Smit said that if they're saying the Ramseys did the murder then they should be charged. Smit also said that Beckner wants to drive the truck in only one direction and that anyone who wants to take a different course is criticized.

Smit also said it angers him that people like Anderson are criticized for sticking up for his theory. Anderson, in turn, said he is proud to back the man he hired to lead his agency's detective bureau.
